These Terms and Conditions apply to all services offered by Sofie.be – Digital Solutions (hereinafter "we", "us" or "the Provider") via the website qrcodemaken.be, and to the legal relationship with every person or entity using these services (hereinafter "you", "the User" or "the Customer").

These terms have been drafted in accordance with: Book VI of the Belgian Code of Economic Law (CEL) – Market practices and consumer protection; Directive 2011/83/EU on consumer rights; the Belgian Act of 11 March 2003 on certain legal aspects of information society services; Directive 2000/31/EC on electronic commerce; and the GDPR (Regulation (EU) 2016/679).

| User content | All content entered or uploaded by the user on the platform, including URLs, texts, images and other data. |
The agreement between the Provider and the User is formed when you create an account and confirm registration via the verification link in your email, or when you take out a paid subscription and payment is confirmed. You must be at least 16 years old to create an account.
qrcodemaken.be offers an online platform for creating, customising, managing and analysing QR codes, including: static QR codes (free, unlimited); dynamic QR codes (subject to subscription plan); visual customisation (colours, logo, style); scan statistics for dynamic QR codes; download options in various formats (PNG, SVG, PDF); and support for multiple QR code types depending on the plan.
The exact features per plan are described on our pricing page. We reserve the right to modify or restrict free plan features without prior notice.
We offer four plans: FREE, STARTER, PRO and BUSINESS. Details of each plan, including prices, features and limits, are available on our pricing page.
All prices are in euros (€) and include VAT (for consumers) unless stated otherwise. For professional users and businesses, prices may be shown excluding VAT; applicable VAT will be added at checkout. VAT is calculated based on your country of residence or establishment, in accordance with Belgian and European VAT rules (Directive 2006/112/EC and the OSS scheme for cross-border digital services).
Paid subscriptions are billed on a monthly or annual basis as chosen at the time of purchase. Subscriptions renew automatically unless cancelled before the end of the current billing period.
We reserve the right to change our prices. Price changes will be communicated to active subscribers at least 30 days in advance by email. You have the right to cancel your subscription before the new prices take effect.
Payments are processed via a certified payment provider. We accept the payment methods listed on our website at the time of payment. In the event of non-payment or failed payment, we reserve the right to restrict or suspend access to premium features. Invoices are delivered electronically by email.
This section applies exclusively to consumers as defined in article 2. Professional users and businesses have no statutory right of withdrawal.
As a consumer, you have the right to withdraw from your purchase within 14 calendar days of the date of purchase, without giving reasons, in accordance with art. VI.47 of the Belgian Code of Economic Law and Directive 2011/83/EU.
You must communicate your decision to withdraw by means of an unambiguous statement (e.g. by email to info@sofie.be). You may use the model withdrawal form below, but are not obliged to do so.
Please note: By purchasing a paid subscription and immediately using the services, you acknowledge that the right of withdrawal may lapse once the digital service has been fully activated. If you wish to preserve your right of withdrawal, do not use the paid features during the 14-day withdrawal period.

I/We (*) hereby give notice that I/we (*) withdraw from my/our (*) contract for the supply of the following service: [description of service/subscription], ordered on [date], name of consumer(s), address of consumer(s), signature (only if this form is notified on paper), date.
(*) Delete as appropriate.
Upon valid withdrawal, we will reimburse all payments received from you, no later than 14 days after the day on which we are informed of your decision to withdraw, using the same means of payment as you used for the original transaction.
The User undertakes to: provide accurate and complete information upon registration and keep it up to date; maintain the confidentiality of their login credentials; immediately notify the Provider of any unauthorised use of their account; use the services only for lawful purposes and in accordance with these Terms; comply with applicable legislation, including the GDPR when processing personal data via QR codes; and take responsibility for all activities occurring via their account.
It is prohibited to use our services for: illegal activities; phishing, fraud or deceptive practices; distribution of malware or harmful software; spam or unsolicited commercial communications; content infringing third-party intellectual property rights; hateful, discriminatory, obscene or violent content; undermining the security or integrity of the platform; automated access (scraping, bots) without prior written permission; or resale of the service without authorisation.
We reserve the right to immediately suspend or terminate your account in case of violation, and to claim damages.
All intellectual property rights in the platform, software, design, logos, texts and other elements of qrcodemaken.be belong to the Provider or its licensors. Copying, reproducing, distributing or otherwise using these without express written permission is not permitted.
You retain all intellectual property rights in the content you enter or upload. By using our services, you grant the Provider a limited, non-exclusive, non-transferable licence to process your content solely to provide the services to you.
QR codes generated by you are your property. You are free to use them for commercial or non-commercial purposes, provided this is in accordance with these Terms.
We aim for 99.5% annual availability, but do not guarantee uninterrupted service. We reserve the right to temporarily interrupt services for maintenance or updates, to modify or remove features, or to permanently discontinue services with at least 60 days' prior notice. We are not liable for damages resulting from temporary unavailability, unless caused by our wilful misconduct or gross negligence.
To the extent permitted by applicable law, the Provider's liability towards professional users is limited to the amount paid by the User in the 3 months preceding the damaging event, with a maximum of €500 per incident. The Provider is not liable for indirect damages, consequential damages, loss of profit, loss of data, reputational damage or loss of revenue.
The statutory rights of consumers are not limited by these provisions. As a consumer, you are entitled to the legal guarantees and protections provided under the Belgian Code of Economic Law.
The Provider is not liable for failure to fulfil its obligations due to circumstances beyond its reasonable control, including but not limited to: natural disasters, pandemics, strikes, hosting or telecommunications outages, cyberattacks, legislative changes or government measures. In the event of force majeure lasting more than 30 consecutive days, either party may terminate the agreement without compensation, with subscription fees refunded pro rata for the undelivered period.
You may delete your account at any time via your account settings or by contacting info@sofie.be. Paid subscriptions are terminated at the end of the current billing period after cancellation; no pro rata refund is given for the remaining subscription period, unless you exercise your statutory right of withdrawal.
We reserve the right to terminate or suspend your account upon: breach of these Terms; non-payment; request from competent authorities; or fraudulent or abusive behaviour.
Upon account termination, your QR codes and data will be deleted in accordance with our privacy policy. Dynamic QR codes will no longer be active after account deletion. We recommend exporting your data before termination.
We reserve the right to amend these Terms. Material changes will be communicated to registered users at least 30 days in advance by email. If you do not agree to the amended terms, you may terminate your account before the effective date. Continued use after the effective date constitutes acceptance of the new terms.
These Terms and all agreements arising from them are governed by Belgian law.
In the event of a dispute, the parties will first attempt to reach an amicable resolution. Please contact us at info@sofie.be.
In the absence of an amicable settlement, the courts of the judicial district of Ghent have jurisdiction, unless mandatory legal provisions prescribe otherwise (for consumers: the court of the consumer's place of residence).
